UK High Court Limits Tort Actions for Crypto Asset Recovery
In *Ping Fai Yuen v Fun Yung Li & Anor* [2026] EWHC 532 (KB) decided on 10 March 2026, Mr Justice Cotter confirmed that the torts of conversion and trespass to goods are unavailable for recovering Bitcoin, despite the Property (Digital Assets etc) Act 2025 granting digital assets property status. The court struck out the conversion and trespass claims but permitted the claimant to amend to pursue proprietary restitution, unjust enrichment, and constructive trust as alternative remedies for allegedly stolen cryptocurrency.
FinCEN Proposes AML/CFT Program Modernization Under BSA
FinCEN published a Notice of Proposed Rulemaking on April 7, 2026, to modernize AML/CFT program requirements under the Bank Secrecy Act, pursuant to the Anti-Money Laundering Act of 2020. The proposal would shift AML/CFT obligations from a process-driven approach to one prioritizing measurable effectiveness and risk-based resource allocation, covering banks, MSBs, broker-dealers, and residential mortgage lenders. FDIC, OCC, and NCUA issued a companion rule on the same date to align their respective requirements with FinCEN's framework, while the Federal Reserve Board did not join.
Federal Banking Agencies Issue Revised Model Risk Management Guidance for Large Banking Organizations
The OCC, Federal Reserve, and FDIC issued revised interagency guidance on model risk management on April 17, 2026, updating and consolidating supervisory expectations for how banks manage models across their businesses. The guidance applies to banking organizations with more than $30 billion in total assets and explicitly excludes generative AI and agentic AI models from scope. The agencies note that non-compliance with the guidance alone will not result in supervisory criticism, but weak model risk management may still constitute unsafe or unsound practices. The guidance rescinds prior model risk guidance issued by each agency and establishes a principles-based, risk-based approach emphasizing proportionality in validation rigor based on model materiality and complexity.
SEC Staff Carves Out a Path: Crypto Interface Providers May Not Be Broker-Dealers
The SEC's Division of Trading and Markets issued guidance establishing a five-year no-action framework permitting providers of covered user interfaces (CUIs)—including DeFi front ends and self-custodial wallet-embedded trading tools—to receive transaction-based and percentage-based compensation without registering as broker-dealers under Section 15(a) of the Securities Exchange Act of 1934, provided they meet specified conditions. The guidance is effective for five years and will be withdrawn April 13, 2031, absent intervening Commission action. Key conditions include requiring fixed charges (not varying by product, route, or counterparty), prohibiting payment for order flow, mandating objective and predisclosed software parameters, and prohibiting involvement in order routing, execution, custody, or investment advice. CUI Providers that cannot satisfy all conditions remain subject to broker-dealer registration requirements.
CFPB Finalizes Regulation B, Removes Disparate Impact
The CFPB finalized Regulation B Subpart A on April 22, 2026, removing the 'effects test' and expressly stating that ECOA does not authorize disparate impact liability. The rule narrows the discouragement prohibition to statements showing intent to discriminate, and restricts for-profit creditors' use of protected characteristics including race, color, national origin, or sex in special purpose credit programs. Consumer advocacy groups are expected to file prompt litigation challenging key portions of the rule, which takes effect 90 days after Federal Register publication.
National Minimum Wage Complaint Dismissed Without Jurisdiction
The WRC Adjudication Officer dismissed complaint ADJ-00060962 filed by Danny Lynch against Shelton Contracting Ltd, finding no jurisdiction to hear the National Minimum Wage claim. The dismissal stems from the complainant's failure to request a pay reference period statement from his employer as required under Section 23 of the National Minimum Wage Act 2000 — a mandatory prerequisite before the WRC can entertain a dispute under Section 24. The officer followed the Labour Court precedent in Mansion House Ltd v Izquierdo, which states the proper course is dismissal without prejudice to the complainant's right to re-enter the complaint having complied with Section 23.
Middle East Conflict Dampens Italy and Global Growth Outlook
Banca d'Italia's Economic Bulletin No. 2/2026 reports that the Middle East conflict has disrupted global supply chains through the Hormuz Strait blockage, driving up energy prices and consumer inflation in both the euro area and the United States as of March. Italy's GDP growth is projected at 0.5% for both 2026 and 2027 in the baseline scenario, with consumer inflation expected to rise to 2.6% in 2026 before declining below 2% in subsequent years; in an adverse scenario, growth could fall by 0.5 percentage points in 2026 and 1 percentage point in 2027 relative to baseline. The bulletin also notes that current account surplus is narrowing due to higher energy import costs and that market interest rate increases following the conflict's outbreak could tighten financing conditions for households and businesses.
