Hearing on Administrative Regulations

The Board is conducting a public hearing on Thursday, December 4, 2025, at 8:30 a.m. at 800 SW Jackson, Lower Level, Topeka, Kansas, to review and consider the adoption of K.A.R. 68-5-17 and 68-7-26, and the revocation of K.A.R. 68-1-1a. Pharmacy Compounding Survey from Kansas Hospital Association

On November 19, 2025, the Kansas Hospital Association sent out a survey to its members requesting feedback regarding the Board’s ongoing work to adopt USP <795> and <797> requirements for pharmacy compounding in Kansas. The survey was sent directly to hospital pharmacy and nurse leaders. The Board encourages pharmacists in hospitals (medical care facilities) and consultant pharmacists to reach out to their leadership and ensure prompt completion of the survey on behalf of their organization. Please note that only one person should respond on behalf of the hospital to avoid duplicate responses. The Kansas Hospital Association plans to collect this information and provide aggregate data to the Board at its meeting in December.

  • The Board recommends you verify the registration status of each pharmacy technician in your

  • If a pharmacy technician has already passed an approved exam, please email pharmacy@ks.gov, fax

 Drug and Device Suppliers

Each entity shipping drugs or devices into Kansas is required to be registered with the Kansas Board of Pharmacy. Have you confirmed the registration status of all of your wholesaler distributors? What about the suppliers you rarely use, or ones you use for that special one-time deal? Do not open yourself or your facility up to discipline by using an unregistered supplier. Each of your suppliers should be able to provide you with an active Kansas wholesale distributor registration number.  CE Programs – How to get Board Approval

Would you like to receive CE credit for a non-ACPE course that has not already been approved by a state (Kansas or other) Board of Pharmacy? Complete and submit a CE Approval Request Form E-200 available on the Board website at https://www.pharmacy.ks.gov/forms-faqs/forms to obtain approval at least 10 days in advance of the scheduled date of the continuing pharmaceutical education. Copies of all CE program materials must be provided with the application for review by the CE Review Committee. Continuing education programs cannot include in-service programs, job orientation or on-the-job training, an education program open to the general public, a CPR or basic cardiac life support course, emergency or disaster training or direct experience at a healthcare facility under a code blue, testing out of a course, or medical school courses. Proof of completion of any approved CE that is not reported to the ACPE-NABP CPE monitor service shall be submitted to the Board within 30 days of completion.

 Flavoring and Regulatory Requirements

The practice of flavoring medications has long been an integral part of the pharmacy profession. At their February 22, 2024, meeting, the Board confirmed their continued opinion that the addition of flavoring to a commercial oral liquid medication is not compounding if certain conditions are met. The conditions that must be met include:

  • The flavoring must not be reactive with the drug or any of its components.
  • The addition must not change the concentration of the medication.
  • A product that has been flavored cannot be returned to stock.
  • An OTC medication cannot be flavored without a prescription.
  • Any flavoring container that does not contain an expiration date must be assigned a 3-year expiration
    date upon opening.

  • Addition of the flavoring must be documented in the prescription record and must include:

  • Flavor added (cherry, grape, etc.)

  • Quantity added

  • Manufacturer of flavoring

  • Expiration date of flavoring
    Please note the board does not speak for other jurisdictions (FDA, other states, etc.) to which a facility may be subject. Be sure to check the expiration date of the flavoring, as inspectors are finding expired flavorings in pharmacy inventory. 3

 CSOS Certificates

Reminder – CSOS signing accounts and passwords cannot be shared! Each person authorized to submit orders

for schedule II controlled substances must have their own CSOS certificate. Please see the DEA CSOS Policy

 Valid Prescription Orders

The Board has been receiving complaints from veterinarians about pharmacies asking them to change the veterinarian on a prescription because the prescribing veterinarian isn’t in their prescriber file and they are too busy … getting ready to close … don’t know how to add a veterinarian. For an animal prescription to be valid there must be a valid prescriber-client-patient relationship. Asking them to change the prescriber for the convenience of the pharmacy is not an acceptable practice. Make sure your staff know how to add veterinarians to your prescriber files and give animal prescriptions the same respect you would give human prescriptions that came in during a busy time or at the end of the day.

 A New Face in the Field

The compliance division is pleased to announce a new inspector to our team. The Kansas Board of Pharmacy welcomes pharmacist Donita (Nita) Gottstein! Nita has worked in retail for the last 29 years. Nita’s primary inspection area will be the counties of Atchinson, Doniphan, Jefferson, Johnson (except for the medical care

facilities), and Wyandotte (except for the medical care facilities).

K-TRACS Update

K-TRACS Honors Committee Members

The Board expresses its sincere gratitude for longtime K-TRACS Advisory Committee members Dr. Joe Davison,

MD, and Dr. Lauren Nelson, PharmD. D r. Davison represented the Kansas Medical Society and served as a

physician representative on the Committee since its inception in 2008. He was instrumental in forming and implementing the prescription drug program in Kansas and was a leader in balancing public health and safety

with preserving necessary access to controlled substances for Kansas patients. Dr. Nelson represented the Kansas Council of Health-System Pharmacy and served as a pharmacist member on the Committee for three years. Both

members brought experience from their careers that proved valuable in helping guide the direction of the K- TRACS program and in evaluating patterns and activities of concern among the patient and healthcare provider populations. The Board thanks them for their service to Kansans.
