Alonzo Criss et al. v. Tony Evers et al. - Civil Rights Complaint Dismissed
The court dismissed Alonzo Criss's civil rights complaint with prejudice for failure to state a claim. Plaintiffs Mary Criss and Alissa Hoag were dismissed because the complaint concerned only Alonzo Criss. Defendants Tony Evers and Morgan Johanning were dismissed for lack of allegations. Criss's claims against defense attorney Adam Witt failed because Criss pleaded no contest and cannot prove innocence of the underlying crimes. Assistant DA Corinne Frutiger is entitled to absolute prosecutorial immunity. Judge Jenna Gill is entitled to judicial immunity. The court recorded a strike against Criss under 28 U.S.C. ยง 1915(g).
Byrd v. Buesgen - Motion to Alter Judgment Denied, Financial Statement Due May 6
Phillip Byrd, a prisoner at Stanley Correctional Institution proceeding without counsel, filed a motion to alter or amend the judgment under Federal Rule of Civil Procedure 59(e) challenging the court's summary judgment ruling in favor of defendants. The court denied Byrd's motion, finding he failed to establish a manifest error of law or fact. The court also directed Byrd to submit a six-month trust fund account statement by May 6, 2026, to determine whether he qualifies for in forma pauperis status on appeal.
Sterling Service Group Must Respond to Sub-Zero Discovery in Appliance Dispute
The US District Court for the Western District of Wisconsin granted defendants Sub-Zero, Inc. and Wolf Appliance, Inc.'s motion to compel discovery against Sterling Service Group, Inc., North East Certified Parts Distribution, LLC, and Pinnacle Appliance Care, LLC. The court found plaintiffs' interrogatory responses deficient and communication breakdown on deposition scheduling warranted judicial intervention. Plaintiffs must provide more complete interrogatory answers, confirm deposition dates, and pay defendants' reasonable attorney's fees for the motion to compel. The deadline for filing dispositive motions is May 1, 2026, and trial is set for November 16, 2026.
