Summary

The International Trade Commission published a notice announcing receipt of a complaint alleging violations of Section 337 of the Tariff Act of 1930 concerning semiconductor devices. The ITC is soliciting written submissions from the public on the public interest factors specified in 19 U.S.C. 1337(d)(1) before determining whether to issue a general exclusion order or limited exclusion order.

What changed

The ITC received a complaint (likely Inv. No. 337-_____) alleging that certain semiconductor devices infringe patents and were imported into the United States in violation of Section 337. The Commission published this Federal Register notice to solicit comments from the public on public interest factors—including whether exclusion orders would affect the public health and welfare, competitive conditions in the U.S. economy, the production of like or directly competitive articles, and U.S. consumers.

Affected parties, including importers, manufacturers, and downstream users of semiconductor products, should file written submissions by the comment deadline to present their positions on public interest considerations. Parties who fail to submit comments may not have their interests adequately considered if the Commission issues exclusion orders affecting the relevant products.

What to do next

  1. File written submissions to the ITC presenting public interest factors by the deadline specified in the notice
  2. Identify whether your company imports or manufactures affected semiconductor devices or relies on potentially infringing articles
  3. Consider whether exclusion orders would affect supply chains, consumer access, or competitive conditions in your sector
