International Trade Commission

1. [Investigation Nos. 701-TA-748-749 and 731-TA-1726-1727 (Final)] On the basis of the record [1 ] developed in the subject investigations, the United States International Trade Commission (“Commission”) determines, pursuant to the Tariff Act of 1930 (“the Act”), that an industry in the United States is materially injured by reason of imports of float glass products from China, provided for in subheadings 7005.10.80, 7005.21.10, 7005.21.20, 7005.29.18, 7005.29.25, 7007.29.00, 7008.00.00, 7009.91.50, and 7009.92.50 of the Harmonized Tariff Schedule of the United States, that have been found by the U.S. Department of Commerce (“Commerce”) to be sold in the United States at less than fair value (“LTFV”), and imports of the subject merchandise from China and Malaysia that have been found to be subsidized by the governments of China and Malaysia. [2 3 ] The Commission further determines that imports of float glass products from Malaysia found by Commerce to be sold in the United States at LTFV are negligible and terminates the antidumping duty investigation concerning Malaysia. [4 ]

Background

The Commission instituted these investigations effective November 21, 2024, following receipt of petitions filed with the Commission and Commerce by Vitro Flat Glass, LLC, Cheswick, Pennsylvania, and Vitro Meadville Flat Glass, LLC, Cochranton, Pennsylvania. The final phase of the investigations was scheduled by the Commission following notification of preliminary determinations by Commerce that imports of float glass products from China and Malaysia were subsidized within the meaning of section 703(b) of the Act (19 U.S.C. 1671b(b)) and sold at LTFV within the meaning of 733(b) of the Act (19 U.S.C. 1673b(b)). Notice of the scheduling of the final phase of the Commission's investigations and of a public hearing to be held in connection therewith was given by posting copies of the notice in the Office of the Secretary, U.S. International Trade Commission, Washington, DC, and by publishing the notice in the Federal Register on August 13, 2025 (90 FR 38991). [5 ] The public hearing in connection with the investigations, scheduled for February 5, 2026, was cancelled. [6 ]

The Commission made these determinations pursuant to §§ 705(b) and 735(b) of the Act (19 U.S.C. 1671d(b) and 19 U.S.C. 1673d(b)). It completed and filed its determinations in these investigations on March 26, 2026.                      The Commission initially voted in these investigations on March 5, 2026. The Commission found that imports of float glass products from Malaysia determined by Commerce to be sold at LTFV were not negligible. Chair Amy A. Karpel, Commissioner Jason E. Kearns, and Commissioner David S. Johanson voted to reconsider their votes in these investigations on March 20, 2026. On March 23, 2026, following this decision to reconsider, the Commission changed its determination in the antidumping duty investigation of imports from Malaysia from affirmative to negative based on negligibility grounds.

                     Due to the lapse in appropriations and ensuing cessation of Commission operations, the Commission tolled its schedule for this proceeding.
