Summary

Illinois House Bill HB4941 passed, amending the Environmental Protection Act to expand Underground Storage Tank Fund eligibility to owners and operators removing tanks installed over 30 years before removal. The bill establishes six specific conditions including non-government ownership, fuel tax compliance, proper registration under the Gasoline Storage Act, and notification to the Illinois EPA and Office of the State Fire Marshal.

What changed

HB4941 amends the Environmental Protection Act to permit Underground Storage Tank Fund access for removal of tanks installed over 30 years prior. The bill specifies six eligibility conditions: tanks cannot be owned by the US Government, fuel cannot be exempt from Motor Fuel Tax Law, costs must be directly related to 30-year-old tank removal, owners must have registered tanks and paid all required fees under the Gasoline Storage Act, and notification must be provided to IEPA and OSFM prior to removal. The legislation expands financial assistance availability for aging underground storage tank infrastructure removal.\n\nTank owners and operators in Illinois removing infrastructure over 30 years old will gain access to state fund reimbursement, provided all statutory conditions are satisfied. Affected parties should audit current tank registrations, ensure fee compliance, and establish notification protocols with state agencies to prepare for potential fund access under the amended program.

What to do next

  1. Review Underground Storage Tank Fund eligibility criteria
  2. Verify tank registration and fee compliance under Gasoline Storage Act
  3. Ensure proper notification procedures to IEPA and OSFM before tank removal
