Summary

The Kentucky Public Service Commission entered an Order establishing a procedural schedule for Case No. 2025-00233, an investigation into Southern Water & Sewer District and its individual commissioners for alleged assessment of an unapproved rate in violation of KRS 278.160. The Order sets procedural requirements including electronic filing pursuant to 807 KAR 5:001, Section 8, and notice requirements for any scheduled hearings. The compliance deadline for parties to request a public hearing or submit the matter for written record decision is May 15, 2026.

“On August 15, 2025, the Commission established this proceeding to investigate Southern Water & Sewer District (Southern District) and its individual commissioners, Bob Shepherd, Donnie Daniels, Rick Roberts, Steve Dawson, and Leslie Byron Scott (collectively, Parties), for the alleged assessment of an unapproved rate in violation of KRS 278.160.”

Why this matters

Kentucky water and sewer districts operating under PSC jurisdiction should audit their recent rate-setting actions to confirm each rate change received PSC approval prior to implementation. Any district that assessed or adjusted rates without explicit PSC authorization may face investigation under KRS 278.160 similar to the action initiated here.

The procedural requirements, including electronic filing in PDF format with proper bookmarks, apply to all parties in the proceeding.
