Fountain Run Water District #1 PSC Formal Investigation Order
Summary
The Kentucky Public Service Commission has established a formal investigation into Fountain Run Water District #1 and its individual commissioners for failing to file a rate adjustment application or provide a detailed explanation of why such an application is not necessary by July 31, 2025, as previously ordered in Case No. 2024-00376. The Commission has issued a procedural schedule establishing May 15, 2026 as the deadline for parties to request a public hearing or submit the matter for a written record decision.
What changed
The PSC initiated this formal investigation on its own motion following Fountain Run Water District #1's failure to comply with a prior Commission order requiring the filing of either a general rate adjustment application, an alternative rate adjustment pursuant to 807 KAR 5:076, or a detailed explanation of why neither is necessary by July 31, 2025. The Order establishes a procedural schedule with May 15, 2026 as the deadline for parties to request a public hearing or submit the matter for a written record decision.
Water utilities regulated by the Kentucky PSC should ensure compliance with all prior rate adjustment orders and filing deadlines, as the Commission has demonstrated willingness to initiate formal enforcement proceedings against non-compliant entities. Parties subject to this proceeding must comply with electronic filing requirements, provide notice of any scheduled hearings, and ensure that sponsoring witnesses appear in person at any hearing.
What to do next
- Fountain Run Water District #1 shall give notice of the hearing in compliance with 807 KAR 5:001, Section 9(2)(b)
- Witnesses who sponsor schedules, testimony, or responses to requests for information shall participate in person at any hearing scheduled in this matter
