Caleb Whitfield v. Lt. Hartford – Eighth Amendment Prisoner Claim Dismissed
The United States District Court for the Northern District of Ohio granted Defendants Lt. Hartford and Correctional Officer Fahle's motion to dismiss pro se Plaintiff Caleb Whitfield's complaint alleging Eighth Amendment violations arising from an April 19, 2023 incident at the Toledo Correctional Institution where Whitfield was struck by a pepper ball after asking about a lock-down command. The court denied Whitfield's motion for leave to file a sur-reply brief because he failed to demonstrate good cause, and denied his motion to schedule discovery as moot. Whitfield alleged the officers' use of force was unnecessary and not applied in good faith to maintain discipline, but the court found he failed to state a plausible Eighth Amendment claim.
Getachew et al. v. City of Willowick - Racial Discrimination in Code Enforcement
Lemma Getachew and Guenet Indale, Ethiopian-American naturalized citizens, filed suit against the City of Willowick and fourteen individual defendants alleging racial discrimination in code enforcement. The complaint alleges that after inspectors learned of plaintiffs' race in 2021-2022, they began increasing enforcement activity at plaintiffs' apartment complex, filing thirteen criminal cases between December 2021 and December 2023; eleven resulted in dismissals or acquittals. The court granted in part defendants' motion for judgment on the pleadings on March 27, 2026.
