TRANSFORMATION BESTIE Opposition Sustained

The TTAB issued a final decision sustaining the opposition filed by Brandy Stewart against registration of the TRANSFORMATION BESTIE mark by Higher Mindset LLC. This decision concludes the opposition proceeding and prohibits the defendant from registering the contested trademark with the USPTO.

Higher Mindset LLC is now barred from obtaining federal trademark protection for the TRANSFORMATION BESTIE mark. The plaintiff Brandy Stewart retains any existing rights to prevent confusion in the marketplace. The defendant may appeal the TTAB decision to the U.S. Court of Appeals for the Federal Circuit if dissatisfied with the outcome.
