Summary

The Texas Court of Appeals, 13th District, has dismissed the appeal in Brenice Morciglio v. Pradip J. Morbia, MD, FACC and Gulf Coast Cardiology Group, PLLC. The dismissal is for want of prosecution due to the appellant's failure to pay the required filing fee by the established deadline.

What changed

The Texas Court of Appeals, 13th District, has dismissed the appeal in case number 13-26-00055-CV, styled Brenice Morciglio v. Pradip J. Morbia, MD, FACC and Gulf Coast Cardiology Group, PLLC. The dismissal, effective February 19, 2026, is for want of prosecution, stemming from the appellant's failure to remit the $205.00 filing fee within the stipulated timeframe after multiple notices.

This action means the appeal will not proceed on its merits. The appellant, Brenice Morciglio, has not paid the fee or responded to the court's notices, leading to the dismissal. This serves as a reminder to litigants and legal professionals of the critical importance of adhering to court procedural rules, including timely payment of fees, to avoid dismissal of appeals.
