Summary

The Pipeline and Hazardous Materials Safety Administration (PHMSA) has published a notice listing new applications for special permits related to the transportation of hazardous materials. These permits allow for deviations from standard regulations under specific conditions. The notice also provides a comment deadline for interested parties.

What changed

PHMSA has published a notice detailing several new applications for special permits under the Hazardous Material Regulations. These applications seek authorization for specific transportation scenarios, including the transport of Division 1.4S articles as limited quantities, wastewater containing explosive materials, prototype batteries, low production lithium metal cells, hydrogen in non-DOT specification cylinders, non-DOT specification pressure drums, and electronic record-keeping for rail transport of hazardous materials. The notice cites 49 U.S.C. 5117(b) and 49 CFR 1.53(b) as the legal basis for these permits.

Interested parties have until April 17, 2026, to submit comments on these applications. The applications themselves are available for inspection at the PHMSA Records Center. This notice serves as an informational publication regarding the receipt of these permit requests, and regulated entities should be aware of the types of deviations being sought and the potential for new or modified operational allowances within the hazardous materials transportation framework.

What to do next

  1. Review the listed special permit applications for relevance to your operations.
  2. Submit comments to PHMSA by April 17, 2026, if any application impacts your business or safety concerns.
  3. Monitor PHMSA's decisions on these special permit applications.
