Audit of FTA's ADA Compliance Oversight
Summary
The DOT Office of Inspector General has initiated an audit to assess the Federal Transit Administration's (FTA) oversight of public transit providers' compliance with Americans with Disabilities Act (ADA) requirements. This audit is prompted by recent class action lawsuits against major transit systems and a lack of recent comprehensive evaluation of FTA's effectiveness in this area.
What changed
The Department of Transportation's Office of Inspector General (DOT OIG) has announced the initiation of an audit focused on the Federal Transit Administration's (FTA) oversight of public transit providers' compliance with Americans with Disabilities Act (ADA) requirements. This audit is being undertaken due to the significant impact of potential ADA violations on the traveling public and the absence of recent comprehensive evaluations of the FTA's oversight mechanisms. The objective is to assess the effectiveness of these mechanisms in ensuring compliance with DOT's ADA regulations.
While this announcement does not impose immediate new compliance obligations, it signals a heightened focus on ADA compliance within the public transit sector. Transit providers should anticipate potential scrutiny from the FTA as a result of this audit. Compliance officers should ensure their organizations' ADA compliance programs are robust and well-documented, as findings from this audit could lead to revised guidance or increased enforcement actions by the FTA. The audit's findings will be critical for understanding the FTA's current oversight effectiveness and identifying areas for improvement.
What to do next
- Ensure public transit providers' ADA compliance programs are robust and well-documented.
- Anticipate potential scrutiny from the FTA regarding ADA compliance.

Audit Initiated of FTA’s Oversight of Public Transit Providers’ Compliance with DOT’s Americans with Disabilities Act Requirements
Origin Self-Initiated Project ID 26S3005S000 File Attachment View PDF Document Within the past 5 years, two of the Nation’s largest transit systems—New York’s Metropolitan Transportation Authority and San Francisco’s Bay Area Rapid Transit—agreed to significant infrastructure improvements to resolve class action lawsuits citing Americans with Disabilities Act (ADA) violations. Within the Department of Transportation, the Federal Transit Administration (FTA) is responsible for ensuring public transit providers comply with applicable ADA laws and regulations. Although FTA has established oversight mechanisms, their effectiveness has not been fully evaluated. Given the impact of potential ADA violations on the traveling public and the lack of recent comprehensive audit work in this area, we are initiating this audit. The objective will be to assess FTA’s oversight of public transit providers’ compliance with DOT’s ADA requirements.
