Summary

The U.S. International Trade Commission has instituted Investigation No. 337-TA-1495 based on a complaint by InterDigital, Inc. alleging patent violations by manufacturers and importers of smart televisions, monitors, and related components. The investigation will examine whether respondents have engaged in unfair practices in the importation of articles infringing InterDigital patents. This is a standard procedural step that initiates the ITC's fact-finding process.

What changed

The ITC formally instituted Investigation No. 337-TA-1495 on April 2, 2026, responding to InterDigital's complaint alleging patent infringement related to video-capable electronic devices including smart TVs and monitors. The investigation covers articles imported into the United States and the parties named in the complaint. The ITC will now begin its fact-finding process, including discovery and evidentiary hearings.

Manufacturers and importers of affected devices should immediately conduct patent clearance reviews to assess their exposure. Parties named in the complaint will need to respond to the ITC's complaint and discovery requests. Failure to participate could result in default findings. Companies should engage IP counsel experienced in Section 337 matters and consider whether licensing negotiations with InterDigital are appropriate.

What to do next

  1. Review product lines for devices that may fall under Investigation No. 337-TA-1495
  2. Engage IP counsel to assess patent exposure and develop litigation strategy
  3. If named as respondent, prepare and submit response to ITC complaint within prescribed deadlines

Penalties

Potential exclusion orders barring importation of infringing articles; cease and desist orders; general exclusion orders affecting an entire industry
