Summary

The Canada Border Services Agency (CBSA) has initiated an expiry review investigation pursuant to SIMA regarding the anti-dumping order on certain whole potatoes exported from the United States for use in British Columbia. The review was triggered by the Canadian International Trade Tribunal's (CITT) initiation on April 1, 2026. CBSA must determine whether the expiry of the order is likely to result in continuation or resumption of dumping.

What changed

The CITT initiated Expiry Review No. RR-2020-002 on April 1, 2026, examining the June 2, 2021 anti-dumping order concerning whole potatoes from the US destined for British Columbia. CBSA has launched its investigation to determine if the order's expiry would likely result in continued or resumed dumping of subject goods. The CBSA determination is due by August 28, 2026, with a Statement of Reasons to follow by September 11, 2026.

Canadian producers, importers, and exporters of subject goods who have not received a questionnaire must contact the CBSA SIMA Registry to obtain one. All questionnaire responses are due by May 11, 2026, and must be filed through the ACE web application. Entities failing to respond may face continued anti-dumping duties if the order is maintained.

What to do next

  1. Submit questionnaire responses through the ACE web application by May 11, 2026
  2. Contact CBSA SIMA Registry at simaregistry-depotlmsi@cbsa-asfc.gc.ca if you have not received a questionnaire

Ottawa,

April 2, 2026

On April 1, 2026, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(1) of the Special Import Measures Act (SIMA), initiated an expiry review of its order made on June 2, 2021, in Expiry Review No. RR-2020-002, concerning the dumping of certain whole potatoes exported from the United States of America, for use or consumption in the province of British Columbia.

As a result of the CITT’s expiry review, the Canada Border Services Agency (CBSA) has today initiated an expiry review investigation to determine, pursuant to paragraph 76.03(7)(a) of SIMA, whether the expiry of the order is likely to result in the continuation or resumption of dumping of the subject goods. The CBSA will make a determination no later than August 28, 2026, and will issue a Statement of Reasons by September 11, 2026.

The product definition and the applicable tariff classification numbers of the goods subject to the CITT’s order are accessible on the CBSA’s Measures in force.

As part of its expiry review investigation, the CBSA forwarded questionnaires to Canadian producers, importers and exporters. Any Canadian producers, importers or exporters who have not received a letter from the CBSA and who wish to provide a response to the questionnaire are advised to contact the CBSA SIMA Registry and Disclosure Unit at the email below.
