Summary

The Texas Court of Appeals, 11th District, has dismissed the appeal in Texas Government Accountability Association v. City of Odessa. The appellant filed a notice of withdrawal, indicating they no longer wished to pursue the appeal of the trial court's decision which declared an interlocal agreement void and unenforceable.

What changed

The Texas Court of Appeals, 11th District, has dismissed the appeal in case number 11-25-00380-CV, styled Texas Government Accountability Association v. City of Odessa. The dismissal follows the appellant's filing of a "Notice of Withdrawal of Appeal," indicating their desire to cease appellate review of the trial court's final order that declared a "Transparency and Ethics Interlocal Agreement" void and unenforceable and issued a permanent injunction.

This action effectively removes the case from the appellate court's docket. For regulated entities, this signifies the finality of the trial court's decision regarding the interlocal agreement. No further compliance actions are required from the appellant related to this specific appeal, as the matter has been concluded by their withdrawal.

Eleventh Court of Appeals

No. 11-25-00380-CV

TEXAS GOVERNMENT ACCOUNTABILITY ASSOCIATION,
Appellant
V.
CITY OF ODESSA, Appellee

On Appeal from the 244th District Court
Ector County, Texas
Trial Court Cause No. C25020212CV

MEMORANDUM OPINION
This appeal arises from the trial court’s final order declaring a “Transparency
and Ethics Interlocal Agreement” void and unenforceable as a matter of law and
providing for a permanent injunction against Appellant. Appellant has filed a
“Notice of Withdrawal of Appeal,” stating that it “no longer desires to appeal from
the final judgment . . . and any other pending matters before this Court.” Appellant
states that it “files this Notice of Withdrawal of Appeal for purposes of dismissing
the pending Appellate review.”
We construe Appellant’s filing as a motion to dismiss its appeal. See TEX. R.
APP. P. 42.1(a)(1). Accordingly, we grant Appellant’s request and dismiss the
appeal. See id.
