What changed

The Mississippi Real Estate Commission issued an Official Letter of Reprimand to Principal Broker Jody Davis for violations stemming from a 2022 real estate transaction in which an associate broker under his supervision failed to properly complete documentation. Specifically, the required Working with a Real Estate Broker form completed with sellers on May 27, 2022, was marked only as "Client (Seller's Agent)" and omitted the required "Client (disclosed Dual Agent)" designation. This omission violated Miss. Code Ann. §73-35-21(1)(n) regarding disclosure requirements and MREC Rule 4.3 supervision requirements.\n\nAffected parties include licensed real estate brokers and their supervising principal brokers in Mississippi, who must ensure that associates properly document dual agency relationships on required forms. Principal brokers are reminded that supervisory failures resulting in documentation violations carry personal disciplinary risk, including potential license suspension or revocation for repeated violations. Brokers should review their transaction documentation practices to confirm that all required disclosures are completed in full.

In Re: THE MATTER OF JODY DAVIS, PRINCIPAL BROKER (MREC Case No. 2022-80)

Dear Mr. Davis: Pursuant to your November 25, 2024, agreement as set forth in the Notice of Alleged Violations and Opportunity

for Informal Resolution for this case, the Commission, in its January 14, 2025, meeting, voted unanimously to

approve said Informal Resolution as offered and agreed, and to issue this Official Letter of Reprimand based upon the following violations of the statutes and administrative rules governing real estate practice in Mississippi. The Investigative Committee of the MREC determined that the information obtained during the investigation of the subject 2022 real estate transaction at issue showed, and that you admitted:

An associate broker (Amanda Edwards) under your supervision failed to properly complete with clients, documentation related to the transaction pursuant to Commission Rules and statutes, to wit:

 The required Working with a Real Estate Broker form (WWREB) completed with the sellers on 5/27/2022 was

only marked "Client (Seller's Agent)" and not (also) marked "Client (disclosed Dual Agent)" as was required if the sellers' agent was to show the home to individuals who were also clients of the licensee. The Investigative Committee determined that the above-noted omission could be shown to have resulted in violations of or related to Miss. Code Ann. §73-35-21(1)(n); 's disclosure requirements, and MREC Rule 4.3

's supervision requirements. MREC Rule 3.1(B)

Consequently, you are hereby reprimanded to fail not in observing the foregoing statutes and rules, on peril of suspension or revocation of your real estate license if similar violations are repeated. Sincerely,

Named provisions

Miss. Code Ann. §73-35-21(1)(n) MREC Rule 3.1(B) MREC Rule 4.3
