Idaho Real Estate License Statutes, Rules, Booklet, Guidelines
The Idaho Real Estate Commission published a compilation webpage of Idaho's real estate licensing statutes, rules, guidelines, and policies. The page includes Chapter 20 Idaho Real Estate License Law, Chapter 26 Department of Self-governing Agencies, Chapter 18 on out-of-state land sales, the License Law and Rules Booklet, and 22 commission guidelines covering topics from advertising and agency disclosure to trust accounts and broker price opinions. A disclaimer states that agency policy statements and guidance documents do not have the force and effect of law under Idaho Code Section 67-5207A.
Trust Account Notification Form for Idaho Real Estate Brokers
The Idaho Real Estate Commission requires designated brokers to submit this notification form disclosing their trust account handling plans. Brokers who will not hold entrusted funds must affirmatively state this obligation. Brokers opening trust accounts must provide complete depository information including bank name, account number, and interest-bearing status.
Idaho Real Estate License Law and Rules Booklet
The Idaho Real Estate Commission published the Idaho Real Estate License Law and Rules Booklet effective July 1, 2022. The document codifies Chapter 20 Title 54 of Idaho Code, establishing licensing requirements, continuing education obligations, examination requirements, license types, and commission powers and duties. The rules apply to all individuals and entities seeking or holding an Idaho real estate license.
Idaho Broker Policy Changes for Disciplinary Action, LCE, and LEO
The Idaho Real Estate Commission has approved changes to its disciplinary policy for Late Continuing Education (LCE) and Late Errors & Omissions (LEO) violations, effective July 1, 2023. The updated policy replaces scaled fine matrices with flat fine amounts, combines LCE and LEO violations into a single pool using a rolling three-year lookback period, and introduces a Commission-developed discipline class as an alternative to monetary penalties for first and second offenses. Third violations will be escalated to the Investigations Department.
