What changed

The Idaho Real Estate Commission requires brokers to complete a Trust Account Notification Form under Idaho Code 54-2041 through 54-2046. Brokers who will not hold entrusted funds must affirmatively state this and acknowledge their obligation to notify the Commission if they open an account in the future. Brokers who will hold entrusted funds must provide complete depository information including bank name, address, account number, phone, fax, and whether the account is interest-bearing.

Affected parties include all Idaho-licensed real estate brokers operating brokerages. Brokers must ensure their depository institutions sign the Agreement and Authorization section, acknowledging that: the broker maintains full control of the account, the depository will provide separate monthly accounting records, and the Commission is authorized to inspect the account upon request. Forms that are incomplete or illegible will be returned without processing.
