Fall Edition October 2023 From The Director

Wow…summer just flew by. As always, I'm excited for the fall season (especially after a really hot summer) and renewal time of course.

The Commission is now under the leadership of Carol Lawhun as chair and

Dave Bonde as vice-chair.

I would like welcome Jessica Doorn is our new Education Director! She has

had this title since February. I forgot to mention it in the spring newsletter.

All Licensees with licenses expiring in 2023 received an email reminding you to go online to renew your license. Please remember that you will need to get

your continuing education done and provide us proof of your E&O Insurance.

The renewal must be received no later than November 30. Renewals

received after that date will have to pay a late fee. If you do not renew your

license by December 31, your license will be placed on an inactive status.

All active licensees who carry errors and omissions insurance from RISC

Insurance Services Company should have received notices to renew your E&O insurance. Even if your license is not due to renew this year, proof that you are current on your E&O insurance coverage needs to be sent to us. If not, your license will be placed on inactive status.

In FY23, we had 477 new licensees.

EPA Measure Impacts Property Managers

Affected are Property Managers Performing Certain Activities in Pre- 1978 Residential Buildings or Child-Occupied Facilities

In its withdrawal of two responses to "Frequently Asked Questions" concerning property managers, the Environmental Protection Agency or EPA shifted responsibility back to property managers to take actions to protect residents and children from lead-based paint and hazardous lead dust from renovations. Now, any property manager, contractor, or person that performs

renovations, repairs, or painting work in residential properties built prior to

1978, or child-occupied facilities, must become an EPA Lead-Safe Certified Firm. The EPA's Lead Renovation, Repair, and Painting (RRP) Rule covers not just renovations, repairs, and painting but also those performing electrical work, plumbing, painting preparation, carpentry, and window replacement. Excluded from the RRP Rule are residential homes built after 1978, housing specifically for the elderly or disabled persons (unless a child under six lives in the property), studio apartments/dormitories, residences declared lead-free by a certified inspector or minor repair/maintenance activities in areas that are less than 6 square feet indoors or 20 square feet outdoors.

The EPA has provided Lead-Safe Certification resources for property

managers on its website. EPA Certification is not applicable in Alabama,

Delaware, Georgia, Iowa, Kansas, Massachusetts, Mississippi, North Carolina, Oklahoma, Oregon, Rhode Island, Utah, Vermont, Washington, or Wisconsin. Businesses in these jurisdictions must apply for certification through their respective state's certification program. The EPA's enforcement of the RRP is accomplished through inspections, subpoenas, and civil administrative actions. Last year, the EPA brought a civil case against Two Chicks and a Hammer, Inc. of HGTV's show Good Bones. The EPA alleged violations of the RRP rule, which were settled with the company agreeing to pay civil penalties of $40,000 and further agreeing to take steps to assure future compliance with the RRP Rule and educate the public about lead-based paint hazards. Other EPA settlements have been reached with renovators on Main Cabin Masters, Texas Flip N Move, Rehab Addict, and Bargain Mansions. In its 2022 Lead Bulletin, the EPA asserted that renovation companies whose work is broadcast on national television have a far-reaching influence on RRP Rule compliance. More information about the RRP Rule and its expansion to property managers is available online at epa.gov.
