In the matter of:

VOLUNTARY SURRENDER OF LICENSE
Recognizing that professional misconduct allegations are now pending against me before the New Hampshire Board of Pharmacy ("Board"), I, Felicia Dern, Reg. Pharm. Tech, hereby voluntarily surrender my New Hampshire License #PHT-130661, effective on the date that the Board accepts this offer of Voluntary Surrender of License.
By voluntarily surrendering my license, I understand that:
- I relinquish all rights and privileges to practice as a Registered Pharmacy Tech licensee in the State of New Hampshire effective upon the Board's acceptance of this Voluntary Surrender of License.
- I acknowledge that this Voluntary Surrender of License has occurred in settlement of pending misconduct allegations as outlined in a complaint received by the Board on or about January 15, 2025.
- The complaint alleges that on or about January 6-7, 2025, while I was employed as a Licensed Pharmacy Tech for Rite Aid Store #04163, in Hillsborough, New Hampshire, I stole/diverted: 28 tablets of Oxycodone 5mg., and 150 tablets of Oxycodone 10mg.
- The complaint further alleges that sometime in October or November of 2024, I stole/diverted 10 tablets of Clonazepam 1mg.
- I acknowledge that when confronted by my employer's Loss Prevention representative, Jeremy Cowles, on January 13, 2025, I admitted my actions and wrote and signed a statement admitting my actions. I was terminated from employment on or about January 17, 2025.
- I acknowledge that I have a substance misuse disorder.
- I acknowledge that I became homeless and lost custody of my son to DCYF as a direct result of my substance misuse disorder.
- I acknowledge my actions, and I apologize for my actions.
- I acknowledge that based upon the evidence available against me and upon my own admissions, the Board would justifiably and rightfully suspend or revoke my license after a hearing pursuant to RSA 541-A:30(III), RSA 310:10, RSA 318, RSA 318-B, N.H. Code Admin. R., Title Ph 806 ("Ph"), and/or N.H. Code Admin. R., Title Plc 206.07("Plc").
I admit to no violations of any State or federal statutes, rules, or ethical provision. However, I do acknowledge that if the matter went to a disciplinary hearing, there are sufficient facts to prove the following:
A. I was employed by Rite Aid Pharmacy at Store #4163 from July 2024 to January 17, 2025, when I was terminated for diversion of drugs.
B. I was licensed as a registered pharmacy tech on August 6, 2024.
C. That on or about January 6-7, 2025, while I was employed as a Licensed Pharmacy Tech for Rite Aid Store #04163, in Hillsborough, New Hampshire, I stole/diverted: 28 tablets of Oxycodone 5mg., and 150 tablets of Oxycodone 10mg. from Rite Aid Store #04163.
D. Further, that sometime in October or November of 2024, I stole/diverted 10 tablets of Clonazepam 1mg. from Rite Aid Store #04163.
E. I acknowledge that on January 13, 2025, I informed Rite Aid Loss Prevention personnel that I had no pills left to turn in.
F. I acknowledge that, at this time, it is in my best interest to voluntarily surrender my license.
G. I acknowledge that until I get my substance misuse disorder under control, working in an environment where I will have direct access to pharmaceuticals is not in my best interest.
- I acknowledge that my Voluntary Surrender of License will be executed and distributed by the Board as a disciplinary action.
- This Voluntary Surrender of License shall be distributed to all relevant licensing authorities and professional societies in the same manner as a final decision making a specific finding of professional misconduct.
- This Voluntary Surrender of License shall become a permanent part of my file and will be maintained by the Board as a public document.
- In the event I apply or reapply for licensure under RSA 318, I must meet all requirements for reinstatement pursuant to RSA 318 and Chapter Part Ph 800.
- I further understand that if at any time I apply for reinstatement of licensure, the Board shall schedule a hearing pursuant to RSA 310, and at that time, these currently pending misconduct allegations settled as part of this Voluntary Surrender of License shall be addressed, in which I shall have the burden of proof to demonstrate why licensure should be reinstated. These misconduct allegations may then form the basis for the Board to deny such application.
- I hereby specifically waive any statute of limitations or laches defense, which might then be available as to these misconduct allegations, including, but not limited to, those contained in RSA 332-G:8 and 9.
- I further specifically waive the 10-day emergency suspension adjudication hearing afforded me under RSA 541-A:30, III and NH Plc Rule 206.07 (b), and the full evidentiary hearing afforded me under NH Plc Rule 206.07(h).
- I voluntarily submit this Voluntary Surrender of License to the Board and state that no promises or representations have been made to me other than those terms and conditions expressly stated herein.
- I have had the opportunity to seek and obtain the advice of an attorney of my choosing in connection with my decision to sign this Voluntary Surrender of License.
- I am of sound mind, and I am not under the influence of any substance that would impair my judgment at the time I sign this Voluntary Surrender of License.
