VOLUNTARY SURRENDER OF LICENSE/REGISTRATION

Recognizing that professional misconduct allegations are now pending against me before the New Hampshire Board of Pharmacy ("Board"), I, Andrew Merdinyan ("Respondent"), consistent with RSA 310:10, VIII (a), N.H. Code Admin. R. Plc 205.04 and 205.05 (b) hereby voluntarily surrender my license/registration to practice as a registered pharmacy technician first granted on February 14, 2025, (#PhT-131188) to settle matters pending before the Board and state as follows:

  1. On or about November 3, 2025, the OPLC Division of Enforcement received a complaint from OPLC Chief Pharmacy Inspector/Investigator Kaitlyn Simoneau. The complaint alleged that Walgreens Pharmacy in Littleton, New Hampshire, had a controlled drug loss that they initially reported on 9/26/2025. Upon further investigation, it was alleged that the Respondent, a certified pharmacy technician, was the employee responsible for the loss. It appears that the total amount of tablets/capsules alleged to have been diverted by Respondent was determined to be ~1,236.

  2. I agree to the following:

B. I acknowledge that this Voluntary Surrender of License/Registration has occurred in settlement of pending misconduct allegations as outlined in a complaint dated November 3, 2025, filed by Kaitlyn Simoneau, as outlined in Paragraph 1.

C. I further acknowledge that my Voluntary Surrender of License/Registration shall be reported by the Board as a disciplinary action.

D. This Voluntary Surrender of License/Registration shall be distributed to all relevant licensing authorities and professional societies with whom the Board has a duty to report in the same manner as a final decision making a specific finding of professional misconduct.

E. This Voluntary Surrender of License/Registration shall become a permanent part of my file and will be maintained by the Board as a public document. I understand this agreement will be publicly posted and available on the oplc.nh.gov website.

F. If I submit an application for licensure/registration under RSA 332-B:9, I am required to meet all requirements then existing for reinstatement of licensure or licensure pursuant to RSA 332-B:9; and/or Ph 300 and Ph 400.

G. I further understand that the pending misconduct allegations may be addressed at a Show Cause Hearing in any future licensure/registration application before the Board at which I shall have the burden of proof. These misconduct allegations may then form the basis for the Board to deny any such application. I hereby specifically waive any statute of limitations


or laches defense, which might then be available as to these misconduct allegations, including, but not limited to, those contained in RSA 332-G:8 and 9.

H. I voluntarily submit this Voluntary Surrender of License/Registration to the Board and state that no promises or representations have been made to me other than those terms and conditions expressly stated herein.

I. I have had the opportunity to seek and obtain the advice of an attorney of my choosing in connection with my decision to sign this Voluntary Surrender of License/Registration.

J. I am of sound mind, and I am not under the influence of any substance that would impair my judgment at the time I sign this Voluntary Surrender of License/Registration.

I agree to all the terms of this Voluntary Surrender.
