De werkgever overtreedt hiermee de Wet Arbeid vreemdelingen (Wav), omdat er geen geldige tewerkstellingsvergunningen voor de medewerkers is geregeld.

Tijdens de controle merkten inspecteurs van de Arbeidsinspectie dat enkele personen die aan het werk waren zich alleen konden identificeren met een foto van hun identiteitsdocument op hun telefoon. 4 van hen hadden een verblijfsvergunning voor asiel. 2 andere personen hadden een verblijfsvergunning voor een ander Europees land, niet Nederland. 1 persoon had een Turks paspoort met een sticker van de IND waarop stond vermeld ‘arbeid niet toegestaan’.
