Denmark Orders Velkommen A/S and Nettopower ApS Immediate Consumer Refunds
Forsyningstilsynet has ordered electricity suppliers Velkommen A/S and Nettopower ApS to immediately repay all outstanding consumer credits. Supervisory inspection found 3,192 delayed payments out of 3,470 cases examined at Velkommen A/S and 2,969 delayed payments out of 3,003 cases examined at Nettopower ApS. The regulator stated it will conduct follow-up supervision and may impose enhanced penalties, including more effective fines under the political agreement of 8 May 2025 on consumer protection in the retail electricity market.
Abolishes Heating Notification Rules Guidance Under Heat Supply Law
Forsyningstilsynet (Denmark's Utility Regulation Authority) has abolished its guidance on notification rules under the heat supply law (VEJ nr. 10041 of 16 March 2022), effective immediately. The authority cited the entry into force on 11 October 2025 of a new regulation on basic contractual rights in the heating and cooling area (kontraktbekendtgørelsen) as the reason the existing guidance is no longer fully accurate. Three documents total have been removed: a declaration of 26 April 2010 on notification deadlines, an FAQ of 11 March 2022, and the guidance itself. Forsyningstilsynet will issue a new FAQ to replace the abolished material.
Updated Guidance on Balance Responsible Parties Obligations Under REMIT Regulation
Denmark's Forsyningstilsynet has updated its 2023 guidance on balance responsible parties' obligations under REMIT Regulation, reflecting the expansion of persons subject to Article 15 through a new paragraph 2 introduced by Regulation (EU) 2024/1106. The update adds PPETs (persons who physically conduct transactions) to the previously covered PPATs (persons who plan transactions), bringing balance responsible parties who transact on balance capacity markets within scope for the first time. Affected parties must establish monitoring and suspicious transaction reporting systems and report to both ACER and Forsyningstilsynet within four weeks.
