Summary

The EFTA Court has issued a judgment against Liechtenstein for failing to fulfill its obligations regarding the implementation of Directive (EU) 2019/770 on contracts for the supply of digital content and digital services. This judgment confirms Liechtenstein's non-compliance with EU digital contract law.

What changed

The EFTA Court has ruled in Case E-13/25, finding Liechtenstein in violation of its obligations under Directive (EU) 2019/770 concerning contracts for the supply of digital content and digital services. The judgment, dated December 10, 2025, specifically addresses Liechtenstein's failure to implement the directive, which aims to harmonize consumer rights related to digital goods and services across the European Economic Area.

This ruling signifies that Liechtenstein must take immediate steps to transpose the provisions of Directive (EU) 2019/770 into its national law. Failure to comply with the Court's judgment could lead to further enforcement actions by the EFTA Surveillance Authority. Businesses operating within or interacting with Liechtenstein regarding digital content and services should ensure their contracts and practices align with the directive's requirements, which typically cover aspects like conformity of digital content, remedies for non-conformity, and consumer rights in digital service agreements.

What to do next

  1. Review Liechtenstein's national legislation for compliance with Directive (EU) 2019/770.
  2. Ensure all contracts for the supply of digital content and services involving Liechtenstein entities adhere to the directive's requirements.
  3. Consult legal counsel regarding any necessary adjustments to business practices or contractual terms.
