Oregon HB4037 - Housing Programs Reform
Summary
Oregon Governor signed HB4037 on April 7, 2026, enacting comprehensive housing reforms including adjusted revolving loan terms for affordable housing projects, limited building permit plan review for housing with two or fewer dwelling units, and established local government land use approval processes for housing subject to clear and objective standards. The Act also creates landlord and tenant responsibilities for residential tenancies destroyed by natural disasters and requires state agencies to prioritize housing providers when transferring surplus real property.
What changed
Oregon HB4037 makes substantive changes to multiple housing programs and regulatory frameworks. The Act modifies revolving loan program terms for cities and counties funding affordable housing, limits building permit plan review for smaller residential projects, and establishes new local government land use approval processes tied to clear and objective standards. Additionally, it creates specific responsibilities for landlords and tenants when residential tenancies are destroyed by natural disasters and requires the Land Conservation and Development Commission to adopt rules on urban reserve land prioritization.
Affected parties including housing providers, local governments, cities, counties, and landlords should prepare for compliance with new requirements ahead of the July 1, 2026 operative date. Housing providers may benefit from priority consideration for surplus state property transfers, while local governments must implement new land use approval processes. Landlords and tenants should establish procedures for handling tenancies affected by natural disasters under the new statutory framework.
What to do next
- Monitor for state agency rulemaking to implement HB4037 provisions
- Review and update property management policies for natural disaster tenancy procedures
- Assess eligibility for priority transfer of surplus state real property as housing provider
