Summary
The Social Security Administration (SSA) is modifying several Privacy Act systems of records. This includes adding a new routine use to permit disclosure to the U.S. Department of the Treasury for fraud prevention and improper payment recoupment. The public comment period ends on December 26, 2025.
What changed
The Social Security Administration (SSA) has issued a notice of modification to its Privacy Act systems of records, specifically adding a new routine use. This amendment allows disclosure of information to the U.S. Department of the Treasury to review SSA's payment and award eligibility through the Do Not Pay Working System. The purpose is to identify, prevent, or recoup fraud and improper payments in state-administered, federally-funded programs, aligning with Executive Order 14249.
Regulated entities, particularly government agencies involved in federal funding, should be aware of these changes to SSA's data sharing practices. The public has a 30-day comment period, with all comments due by December 26, 2025. Compliance officers should review the specific systems affected and consider submitting comments if the expanded data sharing raises concerns regarding privacy or operational impact.
What to do next
- Review the modified Privacy Act systems of records listed in the notice.
- Submit public comments by December 26, 2025, if applicable.
