Veterans Forum vs. Bihar State Housing Board - Execution Application
Summary
The National Green Tribunal (NGT) heard an execution application concerning a prior order imposing a cost of Rs. 10,000 on Respondent 4 (District Magistrate, Saran) for late submission of a reply. The NGT deferred a decision on waiving the cost, requiring the affidavit to be filed first.
What changed
The National Green Tribunal (NGT) addressed an execution application (Execution Application No.01/2024/EZ) related to Original Application No.166/2022/EZ. Specifically, the Tribunal considered a request from the learned counsel for Respondent 4, the District Magistrate of Saran, to waive a cost of Rs. 10,000 previously imposed on January 29, 2026, due to the late submission of a reply. The Tribunal noted that the cost was imposed for this delay and has not yet waived it, pending the submission of the required affidavit on record.
The practical implication is that Respondent 4 must submit the outstanding affidavit to the NGT. Until this is done, the Rs. 10,000 cost remains in effect. The Tribunal has scheduled the next hearing for May 7, 2026, to review the submitted affidavit and make a final decision regarding the waiver of costs. Compliance with this directive is necessary to resolve the pending issue of the imposed cost.
What to do next
- Submit the required affidavit to the National Green Tribunal by the next hearing date.
- Prepare for potential payment of Rs. 10,000 cost if the waiver is not granted.
Penalties
Rs. 10,000 cost imposed for non-submission of reply on time, waiver pending.
