                                   ORDER 1. In this original application, Tribunal is considering the issue of solid

as well as liquid waste management as per orders of the Hon'ble Supreme

Court dated 02.09.2014 in Writ Petition No. 888/1996, [Almitra H. Patel vs.

Union of India & Ors.](https://indiankanoon.org/doc/339109/), with regard to solid waste management and order

dated 22.02.2017 in W.P. No. 375/2012, reported in ([2017) 5 SCC 326,

Paryavaran Suraksha vs. Union of India](https://indiankanoon.org/doc/190799178/), with regard to liquid waste

management (sewage).

  1. Today, matter has been taken up in respect of compliance by State

of Arunachal Pradesh.

  1. The six-monthly progress report in the form of affidavit of Chief

Secretary, State of Arunachal Pradesh dated 03.03.2026 has been filed. We

have examined the said report and found the following status:

Solid Waste:

(i) The ULB-wise status of legacy waste is disclosed in Annexure-12

(page 1179). We have picked up the first ULB in that tabulated 1 information which is Aalo for examining the correctness of the

report. We find that there is a gap of 2.80 TPD in daily generation

and treatment of the solid waste. The report further discloses that

as on July 2025, there was 10100.74 MT of legacy waste. The

untreated daily generated solid waste is adding to the legacy

waste every day. The calculation of legacy waste on the basis of

the cut-off date of July 2025 is not correct and the State ought

to have disclosed the stats of legacy waste on a cut-off date nearer

to the date of filing of the affidavit by the Chief Secretary. This

table further states the timeline for clearing the legacy waste as

May 2026. But without bridging the gap between generation and

treatment, the remediation of the entire legacy waste may not be

possible. Hence, the timeline of May 2026 appears to be

incorrect. However, since the timeline of May 2026 has been

given, therefore, the Chief Secretary, State of Arunachal Pradesh

will ensure that within this timeline the entire legacy waste is

cleared.

(ii) In respect of the daily generated waste, the timeline has been

given in Annexure-8. There also we find that no timeline for

bridging the gap between daily generation and treatment in

respect of Aalo ULB has been given. Same is also the position in

respect of various other ULBs where the gap exists. For some of

the ULBs, the timeline of March 2026 or March 2027 has been

given, but without placing on record the detailed plan for

achieving the said timeline. The Chief Secretary, State of

Arunachal Pradesh will ensure that the gap in daily generation

and treatment is bridged within the said timeline.

(iii) The table-8 further indicates that there is a gap in the generation

and collection of the solid waste. Hence, that gap is also required 2 to be bridged to ensure that the entire solid waste generated

within the ULB is collected and treated.

(iv) In paragraph 12 of the affidavit, it is stated that in next 18 - 24

months, State of Arunachal Pradesh will have 100%

treatment/processing of fresh solid waste, but no definite cut-off

date for achieving this object has been given. Hence, the Chief

Secretary, State of Arunachal Pradesh in his next report will give

clear and definite cut of date for achieving the object of 100%

treatment/processing of the fresh waste.

(v) In the report, the details of sanitary waste collection and

processing have not been disclosed. Hence, the next report of the

Chief Secretary, State of Arunachal Pradesh will cover this aspect

also.

(vi) In the next report, the ULB-wise status of C&D waste be also

disclosed by the State of Arunachal Pradesh.
Liquid Waste:

(i) So far as the liquid waste is concerned, the ULB-wise details have

been disclosed in Annexure-14 to the report. But in that table,

the details and status of sewage drain network and the details of

storm water drains have not been disclosed and it has also not

been disclosed if any storm water drain has been permanently

tapped and diverted to the STP. The State of Arunachal Pradesh

has also not disclosed the final discharge point of the untreated

sewage which is likely to be a natural water source.

(ii) So far as the status of STPs is concerned, the details are disclosed

as follows:

The above chart does not disclose the performance status of

the existing STPs. Hence in the next report, the capacity utilization

and the quality of discharge of treated water from each of these STPs

is required to be disclosed. The above table also mentions the gap in

septage generation and status of existing FSTPs, therefore, their

performance status will also be disclosed in the next report.
4. List the matter on 03.11.2026 for consideration of report in respect

of State of State of Arunachal Pradesh.

  1. For the State of Himachal Pradesh, the matter be listed on

23.03.2026 as per the earlier direction.
