Summary

The National Green Tribunal heard Appeal No. 07/2025/EZ on March 23, 2026. The tribunal granted respondents one week to file reply affidavits, noting that this was a last opportunity for some parties. The bench questioned the maintainability of the appeal and deferred the decision to the regular bench.

What changed

The National Green Tribunal (NGT) Eastern Zone Bench in Kolkata held a hearing on Appeal No. 07/2025/EZ on March 23, 2026. During the hearing, the tribunal granted respondents, including the State of Bihar and the Bihar State Pollution Control Board, one week to file their reply affidavits, explicitly stating this was a final opportunity for some. The tribunal also raised questions regarding the maintainability of the appeal, as it was filed against an order from the Board of Revenue, Bihar, and the appellant could not provide documentation to support the NGT's appellate jurisdiction in this matter.

Compliance officers should note that the NGT has deferred the decision on the appeal's maintainability to the regular bench. The next hearing is scheduled for May 18, 2026. While no immediate compliance actions are required based on this hearing order, legal teams should monitor the next hearing for potential rulings on the appeal's jurisdiction and any subsequent directions. The respondents are under a strict deadline to file their affidavits by the next hearing.

What to do next

  1. Respondents to file reply affidavits by the next hearing date.
  2. Monitor next hearing on 2026-05-18 for jurisdictional ruling.

  1. We find that this is an appeal against order dated 25.03.2025

passed by Board of Revenue, Bihar. We fail to understand as to how this

appeal is maintainable, but it is apprised by the learned counsel for the

appellant that the State of Bihar is the Appellate Authority of the State

Pollution Control Board and hence, this appeal is filed here. But when we

enquired for the order showing that the Board of Revenue, Bihar is the

appellate authority, no such document could be shown.

  1. We leave it to the Regular Bench as to whether this appeal is

maintainable or not.

  1. Put up this matter for next consideration on 18.05.2026.
