Mukherjee vs West Bengal Govt. - Environmental Compliance Hearing
Summary
The National Green Tribunal heard an execution application regarding environmental compliance by the Government of West Bengal. The Tribunal noted delays in sewage collection pit construction, attributing them partly to election processes, and scheduled the next hearing for August 3, 2026.
What changed
The National Green Tribunal (NGT) Eastern Zone Bench in Kolkata held a hearing on an execution application concerning environmental compliance by the Government of West Bengal. The applicant's counsel had not filed a rejoinder to the respondents' affidavits. The District Magistrate and Collector of Birbhum filed an affidavit stating that while the Sewerage Treatment Plant at Tarapith is functional, the sewage collection pit near the vegetable market outfall adjoining the Dwarka river is still not in place. The respondent cited election processes for the delay and suggested a timeline in August 2026 for its completion.
The Tribunal has directed the registry to list the matter for the next hearing on August 3, 2026, and to ensure the applicant's rejoinder is placed on record. The respondent's counsel is also directed to provide a copy of the reply affidavit to the applicant's counsel. This indicates ongoing scrutiny of environmental infrastructure projects and potential delays impacting compliance timelines, requiring close monitoring by the relevant government departments.
What to do next
- Ensure applicant's rejoinder is filed and placed on record.
- Provide a copy of the reply affidavit to the applicant's counsel via email.
- Prepare for the next hearing on August 3, 2026, with updated information on the sewage collection pit.
