                            ORDER 1.    Learned counsel for the applicant has failed to file any rejoinder to

the affidavits filed from the side of respondents so far.

  1. The learned counsel for the respondent 2, District Magistrate and

Collector, Birbhum has filed an affidavit dated 20.03.2026 in compliance

of the previous order passed by this Tribunal wherein attention is drawn

to the averments made in para 4 sub Clause (II) wherein it is made clear

that Sewerage Treatment Plant at Tarapith has been made fully

functional since January 2023 but as regards the sewage collection pit

near vegetable market outfall adjoining Dwarka river for treatment of

sewage effluents generating therefrom, it is submitted by him that, that

pit is yet to be put in place for which when we enquired the learned

counsel as to what should be the outer time limit, he stated that because 1 of the Election process going on, all officials are busy and some date may

be fixed in the month of August 2026.

  1. Therefore, we direct the registry to list this matter for next hearing

on 03.08.2026.

  1. Learned counsel for the applicant said that he has already filed the

rejoinder through email but we have not found the same placed on

record. Therefore, we direct the registry to place it on record.

  1. Learned counsel for respondent 2 is further directed to provide a

copy of the reply affidavit to the learned counsel for the applicant through

email.

  1. Put up this matter for next consideration on 03.08.2026.
