Summary

The National Green Tribunal (NGT) Pune Bench heard the case Sagar Kantilal Devre vs. Maharasthra Pollution Control Board on March 16, 2026. The tribunal granted an additional six weeks for respondents to devise a formula for calculating Environmental Damage Compensation (EDC) and to study submitted judgments.

What changed

The National Green Tribunal (NGT) Pune Bench, in the case of Sagar Kantilal Devre vs. Maharasthra Pollution Control Board (Original Application No. 102/2022 (WZ)), has granted respondents an extension of six weeks to finalize a formula for calculating Environmental Damage Compensation (EDC). This extension is also to allow time for the study of judgments submitted by other respondents. The tribunal has directed the counsel for respondents 6 to 12 and 14 to formally place their relied-upon judgments on record with pagination for the tribunal's reference.

Regulated entities, particularly those involved in environmental compliance and potentially subject to EDC calculations, should note the ongoing development of these formulas. While this specific order grants an extension, it indicates the NGT's active engagement in establishing clear calculation methods. Compliance officers should monitor future proceedings in this case, especially the next hearing scheduled for June 24, 2026, to understand the finalized EDC calculation methodology and any associated reporting or payment obligations. Failure to comply with future directives could result in penalties.

What to do next

  1. Monitor next hearing on 2026-06-24 for finalized EDC calculation formula.
  2. Ensure relevant judgments are placed on record by counsel for respondents 6-12 and 14.
  3. Prepare for potential implementation of new EDC calculation methods.

nos. 2 & 3-MPCB have sent us an email dated 13.03.2026, informing that

they were directed to sit together to devise the formula, which could be

applied in the present case to calculate EDC. Additional six weeks' time is
