ANEEL Public Consultation CUST Adjustments for Generators Benefiting from Deadline Extensions

ANEEL opened a 20-day public consultation (April 23 – May 12, 2026) to regulate adjustments to the start date of Transmission System Use Contracts (CUST) for power generation projects that benefited from exceptional deadline extensions under Provisional Measure 1,212/2024. Generators with signed CUSTs that have not yet commercialized energy in the Regulated Contracting Environment (ACR) may adjust their CUST start date without cost, subject to the new operational entry deadline in their grant. ANEEL proposes that deferral requests must be submitted by March 31 before the tariff cycle, and an exceptional 2026 deadline of May 29, 2026 applies while regulations are being finalized. ANEEL Meets Investment Analysts on Enel São Paulo Concession and Sector Reforms

ANEEL hosted a meeting in Brasília on April 23, 2026, with investment analysts to explain regulatory developments in Brazil's electric sector, including the ongoing caducidade (concession cancellation) recommendation process for Enel São Paulo, which has given the distributor 30 days to present its defense. ANEEL superintendents also outlined upcoming public consultations on the Productivity Component (Pd) of the X Factor and on Non-Technical Losses, to be opened later in 2026, as well as energy storage regulation for the LRCAP Baterias auction reserve capacity.
