Compartilhe: Publicado em 22/04/2026 18h37 A Diretoria da Agência Nacional de Energia de Elétrica (ANEEL) aprovou hoje (22), durante Reunião Pública Ordinária, abertura de consulta pública para discutir a regulamentação das mudanças na Lei nº 9.427/1996, após a inclusão do §1º-W pela Lei nº 15.269/2025.

Essa mudança permite que alguns empreendimentos de geração de energia que foram beneficiados pela prorrogação excepcional de prazos da MP nº 1.212/2024 possam alterar a data de início do Contrato de Uso do Sistema de Transmissão (CUST).

Com o novo §1º-W, empreendimentos que solicitaram prorrogação com base na MP nº 1.212/2024 e que já possuem CUST assinado e não comercializaram energia no Ambiente de Contratação Regulada (ACR) poderão ajustar a data de início do CUST livremente e sem custo, desde que respeitem o novo prazo de entrada em operação definido na outorga.

Em relação à postergação do CUST, a proposta da ANEEL é que se o empreendedor quiser adiar o início do contrato:

  • o pedido deve ser feito até 31 de março anterior ao ciclo tarifário;
  • se o pedido for feito depois desse prazo, a mudança só valerá em ciclos tarifários futuros;
  • em alguns casos, o contrato precisará continuar vigente até o fim do ciclo tarifário atual ou seguinte. Já em relação à antecipação do CUST, a proposta é que se o empreendedor quiser antecipar a data continua em vigor o procedimento normal e será necessário um Parecer de Acesso do ONS, comprovando disponibilidade do sistema elétrico.

No que diz respeito à garantia prévia (GPC), nos contratos assinados sem Garantia Prévia para Celebração do CUST, a proposta é que o ajuste da data só ocorra após apresentação dessa garantia. A Agência propõe ainda que, como a regulamentação ainda está sendo criada, o prazo excepcional para pedidos de postergação em 2026 seja até 29 de maio de 2026.
