Gentry v. Holzer Health System - Stipulated Protective Order
Chief District Judge Sarah D. Morrison entered a Stipulated Protective Order in Violet Gentry v. Holzer Health System (Case No. 2:25-CV-1340) establishing confidentiality obligations for discovery materials. The order permits parties to designate documents as "CONFIDENTIAL – SUBJECT TO PROTECTIVE ORDER" or "ATTORNEYS' EYES ONLY – SUBJECT TO PROTECTIVE ORDER" based on good-faith assertions of protected information. Materials may include confidential personal information, patient information, medical information, trade secrets, and competitively sensitive commercial information. The order restricts use of confidential information to purposes of the litigation and requires designated deposition testimony within 30 days of transcript receipt.
Williams v. Warden - Habeas Corpus Drug Offense Sentencing
Magistrate Judge Michael R. Merz issued a Report and Recommendations in Cameron D. Williams v. Shelbie Smith, Warden, recommending denial of a habeas corpus petition brought under 28 U.S.C. §2254. The pro se petitioner challenged his 54-month sentence for fentanyl-related possession and evidence tampering from Muskingum County, Ohio, raising three grounds: disproportionality of sentence under the Eighth Amendment, inconsistency with Ohio sentencing statutes, and unauthorized imposition of consecutive sentences. Compound Property Management LLC v. Build Realty Inc. - Class Action Settlement Approval
The US District Court for the Southern District of Ohio granted final approval of a class action settlement in the matter of Compound Property Management LLC et al. v. Build Realty Inc. et al. (Case No. 1:19-cv-133), awarding $1,300,000 to settle claims arising from a real-estate investment 'flip' scheme. The court approved class counsel attorneys' fees in the amount of one-third of the common fund, $163,940.77 in litigation costs and expenses, and $10,000 service awards to each named Plaintiff. The certified class claims were limited to civil RICO and breach of fiduciary duties.
