Washington v. Bisignano - Court Affirms Partially Favorable SSA Disability Ruling

Jonathan Washington prevailed in this federal court action challenging the Commissioner of Social Security's denial of Supplemental Security Income benefits. Washington, who suffers from blood cancer, high blood pressure, blood clots, stroke, torn ACL, and lupus, was initially denied benefits before an administrative law judge found him disabled beginning July 23, 2023. The Appeals Council issued a partially favorable decision on December 13, 2024, and the district court has now affirmed that decision as the final decision of the Commissioner.

Patrick M. Bass v. United States - § 2255 Motion Denied, ACCA Enhancement Upheld

The United States District Court for the Middle District of Alabama denied Patrick M. Bass's motion under 28 U.S.C. § 2255 to vacate his 240-month sentence, rejecting claims of ineffective assistance of counsel, prosecutorial misconduct, and judicial misconduct related to his Armed Career Criminal Act enhancement. The court found counsel's performance was not deficient and Bass failed to demonstrate prejudice under Strickland v. Washington. The Eleventh Circuit had previously rejected Bass's direct appeal challenging the ACCA enhancement based on three prior first-degree marijuana possession convictions.

Greene v. City of Tuskegee Partial Dismissal Granted

US District Court M.D. Alabama granted Defendants' Motion for Partial Dismissal in Greene v. City of Tuskegee, dismissing all fictitious parties and the Tuskegee Police Department as a named defendant with prejudice. The court found the dismissal warranted under Rule 12(b)(6), applying the plausibility standard from Ashcroft v. Iqbal and Bell Atlantic Corp. v. Twombly.
