Hiep Thi Phan v. Carolyn Lee - Appeal Dismissed
Summary
The Georgia Court of Appeals dismissed appeal number A26A1474 (Hiep Thi Phan et al v. Carolyn Lee) on April 21, 2026. The appellants failed to file their enumerations of error and brief within 20 days of docketing as required, and did not request an extension of time.
“Accordingly, pursuant to Court of Appeals Rules 7 and 23(a), this appeal is hereby DISMISSED.”
What changed
The Court of Appeals dismissed the appeal because appellants failed to file their enumerations of error and brief by the March 26, 2026 deadline, 20 days after the March 6, 2026 docketing date, and did not seek an extension. The dismissal was issued pursuant to Court of Appeals Rules 7 and 23(a).
Affected parties (appellants in Georgia appellate proceedings) should ensure timely compliance with enumeration and brief filing deadlines, as failure to do so may result in automatic dismissal of the appeal without further notice.
