Summary

Singapore's Minister for Law responded to a parliamentary question confirming that no ASEAN Member State has ratified the ASEAN Treaty on Extradition as of April 2026. The Treaty was adopted on 14 November 2025 but has not yet entered into force. Singapore indicates it will need to update its Extradition Act notifications to extend application to the ASEAN Treaty upon entry into force.

What changed

The Minister confirmed that the ASEAN Extradition Treaty signed in November 2025 remains unratified by any ASEAN Member State, and no agreed timeframe exists for the Treaty's entry into force. Singapore's only stated preparatory step is updating the Extradition Act to extend its application to the ASEAN Treaty upon entry into force.

This informational response has no immediate compliance implications for businesses or individuals. Legal practitioners and law enforcement agencies should note that the Treaty remains in a preparatory phase and that Singapore's ratification process is contingent on other ASEAN Member States ratifying first.

What to do next

  1. Monitor ASEAN Member State ratification progress
  2. Prepare Extradition Act updates for ratification
  3. Track development of agreed timeframe for Treaty entry into force

Question
To ask the Minister for Law (a) how many ASEAN Member States have ratified the ASEAN Treaty on Extradition signed in November 2025; (b) what are the preparatory steps Singapore needs to undertake before being able to ratify the Treaty; and (c) whether there is an agreed timeframe within which the Treaty is to be brought into effect.

Written Answer:

1. The ASEAN Extradition Treaty was adopted on 14 November 2025. No ASEAN Member State has ratified the Treaty to date, and there is no agreed timeframe among ASEAN Member States on when to bring the Treaty into force.

2. To be able to ratify the ASEAN Treaty on Extradition, Singapore must update the Extradition Act notifications to extend its application to the ASEAN Treaty on Extradition, upon the entry into force of the Treaty.
