Summary

The Louisiana Court of Appeal denied Antoine Edwards, Sr.'s supervisory writ application challenging the March 13, 2026 dismissal of his action against the Louisiana Department of Public Safety and Corrections. The court held that the dismissal constituted a final appealable judgment under La. R.S. 15:1177(A)(10), and clarified that appeals must be taken by filing a motion for appeal in the district court within the delays specified in La. Code Civ. P. art. 2087.

What changed

The court denied the supervisory writ and clarified the procedural requirements for appealing a final judgment in a case involving the Louisiana Department of Public Safety and Corrections. The court confirmed that the March 13, 2026 dismissal was a final appealable judgment under Louisiana law, and that an appeal must be initiated by filing a motion in the district court, not by filing documents directly with the court of appeal. Filing documents directly with the appellate court does not suspend the running of appeal delays.

For parties in similar matters, this ruling reinforces that supervisory writ applications are not a substitute for timely appeals, and that litigants must strictly observe appeal delays under Louisiana's Code of Civil Procedure. The case provides procedural guidance on the distinction between supervisory writs and appeals in Louisiana state court practice.

What to do next

19th Judicial District Court, Parish of East Baton

Rouge, No. 753477.

WRIT DENIED. The March 13, 2026 judgment dismissing relator' s
action is a final appealable judgment. See La. R. S. 15: 1177 ( A) ( 10) .

An appeal of a final judgment is taken by filing a motion for

appeal in the district court, along with an order for the judge' s
signature showing the return date of the appeal, within the delays
set out in La. Code Civ. P. art. 2087. Filing documents directly
with this court does not suspend the running of the appeal delays.
