20-Year Prison Sentence for Attempted Aggravated Femicide in Ibagué, Tolima
Summary
A knowledge judge in Ibagué, Tolima, sentenced a 46-year-old man to 20 years in prison for the November 19, 2021 knife attack on his ex-partner. The Fiscalía General de la Nación presented evidence showing the victim endured years of violence during cohabitation. The defendant was found guilty of attempted aggravated femicide and barred from holding public office for the same period, denied conditional release and house arrest. This first-instance ruling is subject to appeal.
Domestic violence cases in Colombia involving documented patterns of prior abuse may now face aggravated femicide charges rather than standard homicide or assault charges alone. Legal aid organizations and victim advocacy programs should ensure clients understand the evidentiary value of preserving all records of prior abuse incidents, including police reports, medical documentation, and witness statements, as these can directly influence charge escalation and sentencing severity in subsequent violent incidents.

What changed
The defendant was found guilty of attempted aggravated femicide under Colombian criminal law. The court applied the aggravated form based on evidence of sustained domestic violence during the years the victim and aggressor lived together, establishing a documented pattern of abuse that preceded the November 2021 knife attack.
Criminal defense practitioners and domestic violence advocacy programs should note that the court's reasoning explicitly incorporated the victim's history of cohabitation-era violence as an aggravating factor. This framing underscores the importance of thorough documentation of prior abuse incidents — police reports, medical records, and witness testimony — as these records can directly influence the severity of charges and sentencing outcomes in subsequent violent incidents.
Penalties
20 years of imprisonment; ineligibility to hold public office for the same period; denial of conditional release and house arrest.
