Certain TOPCon Solar Cells Investigation Institution
Summary
The International Trade Commission has instituted an investigation into certain TOPCon solar cells, modules, panels, components thereof, and products containing same. This action follows a complaint alleging unfair import practices.
What changed
The International Trade Commission (USITC) has initiated an investigation, designated as Investigation No. 337-TA-1494, concerning alleged unfair import practices related to certain TOPCon solar cells, modules, panels, components thereof, and products containing the same. This institution of investigation is based on a complaint filed with the USITC, which alleges violations of Section 337 of the Tariff Act of 1930. The specific nature of the alleged unfair practices and the parties involved will be detailed in the full document.
This investigation will proceed to determine whether there is a violation of Section 337. Companies involved in the manufacturing, importing, or distribution of these solar products should review the complaint and the USITC's institution notice carefully. While this notice does not specify a compliance deadline, the investigation will involve discovery, evidentiary hearings, and a final determination by the Commission. Failure to comply with the investigation's requirements or a finding of violation could lead to import restrictions or other remedies.
What to do next
- Review the USITC's institution notice for Investigation No. 337-TA-1494.
- Assess potential involvement in the investigation concerning TOPCon solar cells, modules, and related products.
- Consult legal counsel regarding potential obligations and participation in the investigation.
