Summary

The U.S. International Trade Commission voted to institute Investigation No. 337-TA-1496 based on a complaint by InnoTV Labs alleging patent infringement by nine respondents including Hisense, Roku, and Purple Tag Media Technology. The investigation covers certain display devices, streaming players, and components imported into the United States. The complainant seeks limited exclusion orders and cease and desist orders.

What changed

The USITC has instituted a Section 337 investigation (Inv. No. 337-TA-1496) regarding certain display devices, streaming players, and components thereof. The complaint, filed by InnoTV Labs, LLC on March 2, 2026 (supplemented March 17, 2026), alleges patent infringement violations under Section 337 of the Tariff Act of 1930. Nine respondents have been named: Hisense Co., Ltd. and five affiliated entities (China, Mexico, and Georgia); Roku, Inc. (California); and Purple Tag Media Technology entities (China and Mexico). Relief requested includes limited exclusion orders and cease and desist orders.

Respondents should retain Section 337 counsel immediately and prepare defense strategies. The USITC will assign an administrative law judge and set a target date within 45 days of institution. Remedial orders become effective when issued and final 60 days after issuance unless disapproved by the U.S. Trade Representative. Importers of the affected products face potential exclusion from U.S. markets if a violation is found.

What to do next

  1. Retain Section 337 counsel if named as a respondent
  2. Assess whether affected products are subject to the investigation
  3. Prepare defense strategy and evidentiary submissions for the evidentiary hearing

Penalties

Potential limited exclusion orders blocking importation of infringing products; potential cease and desist orders preventing domestic sales; remedial orders become final 60 days after issuance unless disapproved by the U.S. Trade Representative

The U.S. International Trade Commission (Commission or USITC) voted to institute an investigation of certain display devices, streaming players, and components thereof. The products at issue in the investigation are described in the Commission’s notice of investigation.

The investigation is based on a complaint filed on behalf of InnoTV Labs, LLC of Las Vegas, Nevada, on March 2, 2026. A supplement to the complaint was filed on March 17, 2026. The complaint, as supplemented, alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain display devices, streaming players, and components thereof that infringe certain claims of the patents asserted by the complainant. The complainant requests that the USITC issue a limited exclusion order and cease and desist orders.

The USITC has identified the following respondents in this investigation:

  • Hisense Co., Ltd., Qingdao, China
  • Hisense International Co., Ltd., Qingdao, China
  • Hisense Visual Technology Co., Ltd., Qingdao, China
  • Hisense USA Corporation, Suwanee, Georgia
  • Hisense Electronics Manufacturing Company, Suwanee, Georgia
  • Hisense Monterrey Home Appliance Manufacturing, S. de R.L. de C.V., Nuevo Leon, Mexico
  • Roku, Inc., San Jose, California
  • Purple Tag Media Technology (Shanghai) Ltd., Shanghai, China
  • Purple Tag Media Technology (Shanghai) Ltd. – Shenzhen Branch, Guangdong, China
  • Purple Tag Mexico, S.A. de C.V., Ciudad de México, Mexico By instituting this investigation (337-TA-1496), the USITC has not yet made any decision on the merits of the case. The USITC’s Chief Administrative Law Judge will assign the case to one of the USITC’s administrative law judges (ALJ), who will schedule and hold an evidentiary hearing. The ALJ will make an initial determination as to whether there is a violation of section 337; that initial determination is subject to review by the Commission.

The USITC will make a final determination in the investigation at the earliest practicable time. Within 45 days after institution of the investigation, the USITC will set a target date for completing the investigation. USITC remedial orders in section 337 cases are effective when issued and become final 60 days after issuance unless disapproved for policy reasons by the U.S. Trade Representative within that 60-day period.
