Summary

The Scottish Ministers have issued the Scottish Languages Act 2025 (Commencement No. 2) Regulations 2026, bringing specific sections of the Act into force on various dates throughout 2026 and 2027. These regulations appoint commencement dates for provisions related to linguistic significance in local government areas and support for Gaelic language institutions.

What changed

The Scottish Ministers have issued the Scottish Languages Act 2025 (Commencement No. 2) Regulations 2026, which designate specific commencement dates for key provisions of the Scottish Languages Act 2025. Section 4 of the Act, concerning the designation of areas of linguistic significance by local authorities, will come into force on March 21, 2026, for Na h-Eileanan an Iar, September 1, 2026, for Highland and Argyll and Bute, and January 1, 2027, for all other local government areas in Scotland. Additionally, sections 32(2), (3), (4), (6), and (7) of the Act, requiring support for Sabhal Mòr Ostaig as the national centre for Gaelic language, education, and culture, will come into force on September 15, 2026.

These regulations establish a phased implementation of the Scottish Languages Act across different regions of Scotland. Local government agencies and the Scottish Ministers are directly affected by these commencement dates. The primary action required is for local authorities to be aware of and prepare for the implementation of section 4 within their respective areas, with specific dates dictating when they can formally designate areas of linguistic significance. The Scottish Ministers are also mandated to take action to support Sabhal Mòr Ostaig by September 15, 2026. No specific penalties for non-compliance are detailed in this commencement notice, but adherence to the appointed days is expected.

What to do next

  1. Local authorities to prepare for the implementation of section 4 of the Scottish Languages Act 2025 on the appointed dates.
  2. Scottish Ministers to take appropriate action to support Sabhal Mòr Ostaig by September 15, 2026.
