The Illinois Department of Labor (IDOL) has filed a wage theft complaint against That’s Gino and Marty’s restaurant and its owners in Cook County Circuit Court. The complaint alleges violations of the Illinois Wage Payment and Collection Act and the Illinois Minimum Wage Law, seeking over $20,000 in unpaid wages for at least nine employees.

What changed

The Illinois Department of Labor (IDOL) has initiated an enforcement action by filing a complaint in Cook County Circuit Court against That’s Gino and Marty’s, LLC, its management company, and several individual owners and managers. The complaint alleges violations of the Illinois Wage Payment and Collection Act and the Illinois Minimum Wage Law, stemming from unpaid wages, tips, and improper overtime compensation for employees between December 2023 and August 2025. IDOL has identified at least nine employees owed over $20,000 in unpaid wages, with additional damages and statutory penalties being sought.

This action requires immediate attention from employers operating in Illinois, particularly those in the food service industry. Compliance officers should review their wage and hour practices to ensure adherence to state minimum wage, overtime, and tip payment laws. Employees who believe they may be owed wages are encouraged to file a claim with IDOL. Failure to comply with Illinois wage laws can result in significant financial penalties and legal action, as demonstrated by this case.

What to do next

  1. Review payroll and compensation practices for compliance with Illinois Wage Payment and Collection Act and Illinois Minimum Wage Law.
  2. Ensure all earned wages, tips, and overtime are paid accurately and on time.
  3. Consult legal counsel regarding potential exposure and remediation if non-compliance is identified.

Penalties

Additional damages and statutory penalties sought under Illinois law.

Action seeks to recover unpaid wages for restaurant workers
SPRINGFIELD – The Illinois Department of Labor (IDOL) has filed a complaint in Cook County Circuit Court against That’s Gino and Marty’s, LLC, its management company White Glove Service and Management, LLC, and several individual owners and managers, alleging violations of the Illinois Wage Payment and Collection Act and the Illinois Minimum Wage Law.
The complaint alleges that from December 2023 through August 2025, employees at the restaurant located in Chicago’s West Loop were not paid some earned wages, including tips and gratuities, and that some workers were paid below the state’s minimum wage and were not properly compensated for overtime hours worked.
Following a preliminary investigation, IDOL determined that at least nine employees were collectively owed more than $20,000 in unpaid wages, with additional damages and statutory penalties sought under Illinois law.
“Illinois law is clear: workers must be paid fully, fairly, and on time,” said Illinois Department of Labor Director Jane Flanagan. “When employers withhold earned wages, or ignore minimum wage and overtime requirements, the Department will use every tool available to recover wages owed and hold responsible parties accountable.”
The case was filed by the Office of the Illinois Attorney General on behalf of IDOL. The allegations outlined in the complaint are claims only and have not yet been adjudicated by the court.
Employees who believe they may be owed wages are encouraged to file a claim with IDOL.
