The 2026 civil penalty adjustment has not yet been finalized and remains pending the release of the corresponding adjustment by the federal Occupational Safety and Health Administration (OSHA).

The Hawaii Occupational Safety and Health Division (HIOSH) is required to remain aligned with federal OSHA penalty adjustment requirements. As such, the State’s 2026 penalty update will be implemented following the Federal Government’s publication of its official adjustment.

Upon release of the federal adjustment, HIOSH will promptly review and adopt the updated penalty structure in accordance with applicable state and federal requirements. Additional information will be provided at that time. Until then, the existing 2025 penalty structure will remain in effect.
