New Mexico Attorney General Raúl Torrez joined 23 colleagues filing suit in the U.S. District Court for the District of Massachusetts challenging President Trump's March 31 Executive Order on election control. The lawsuit argues the order unlawfully attempts to establish federal authority over state-run elections in violation of the Electors Clause and the 10th Amendment.
Separately, New Jersey AG Jennifer Davenport led a coalition of 23 attorneys general and one governor in filing a similar challenge, while another coalition of 21 AGs filed an amicus brief protecting law firms targeted by executive orders.
State election officials should monitor these cases closely, as adverse rulings could affect their ability to implement federal election requirements independently.
