Maine Insurance Bulletin on Agency Termination and Policy Cancellation
Summary
The Maine Bureau of Insurance issued Bulletin 489 to clarify that terminating an agency relationship is not a lawful basis for nonrenewal of homeowners, renters, or personal auto policies. Insurers must adhere to Maine's Cancellation Control Acts and provide explicit reasons for nonrenewal.
What changed
The Maine Bureau of Insurance issued Bulletin 489 to address instances where insurers have nonrenewed homeowners, renters, or personal auto policies solely due to the termination of an agency relationship. The bulletin clarifies that this is not a lawful basis for nonrenewal under Maine's Cancellation Control Acts. Insurers are reminded that policyholders have a right to renew their policies unless a valid reason specified in the relevant Acts is provided, and vague explanations are insufficient.
Insurers and producers must ensure that any nonrenewal notices explicitly state the permissible reasons for nonrenewal as defined by the Maine Automobile Insurance Cancellation Control Act or the Maine Property Cancellation Control Act. Producers who no longer represent an insurer can offer alternative coverage, but this does not negate the policyholder's right to renew their existing policy. The bulletin encourages review of Bulletin 391 for detailed guidance on agency terminations and book rollovers.
What to do next
- Review Bulletin 489 and Bulletin 391 regarding agency terminations and policy nonrenewals.
- Ensure nonrenewal notices for homeowners, renters, and personal auto policies explicitly state valid reasons compliant with Maine's Cancellation Control Acts.
- Update internal nonrenewal procedures to reflect that agency termination is not a permissible basis for nonrenewal.

Mills Governor Robert L. Carey Superintendent Joan F. Cohen Commissioner Bulletin 489 Termination of Agency Relationships and Maine’s Cancellation Control Acts It has come to the Bureau’s attention that some Maine consumers have recently had their homeowners, renters, or personal auto policies nonrenewed solely because the insurer’s agency relationship with a producer has terminated. This is not a lawful basis for nonrenewal. Insurers are reminded that in Maine, these lines of business are subject to Cancellation Control Acts that grant policyholders the right to renew their policies unless the insurer can demonstrate a valid reason for nonrenewal. The only permissible reasons for nonrenewal are those specified in the Maine Automobile Insurance Cancellation Control Act or the Maine Property Cancellation Control Act, as applicable. For all policies that are subject to either Control Act, the reason or reasons for nonrenewal action must be explicitly stated in the notice of nonrenewal. Vague explanations such as “underwriting reasons” are insufficient. Producers who no longer represent a particular insurer are free to offer policyholders alternative coverage with a different insurer, but that does not extinguish the policyholders’ right to renew the coverage they have. The rights of policyholders and the obligations of insurers and producers in these situations are discussed in detail in Bulletin 391, Personal Lines Agency Terminations and Book Rollovers, which insurers and producers are encouraged to review prior to the termination of an agency relationship.
