Details

Part 2A Orders are legal powers under the Public Health Act that allow local authorities, through an application to a magistrate, to obtain additional powers to manage a person, item, or premises that pose a significant risk to human health from infection or contamination. These orders are intended as a last resort when other approaches have failed or are unsuitable.

A magistrate may grant a Part 2A Order only if the conditions in the 2010 Health Protection Regulations are met. Local authorities usually seek these orders in collaboration with organisations such as the UK Health Security Agency (UKHSA), the NHS or emergency services.

Whenever a Part 2A Order is applied for, the local authority must submit a written report to UKHSA at Part2AOrders@ukhsa.gov.uk. UKHSA monitors all reported orders but does not intervene in individual cases. It is required to publish anonymised information on the use of Part 2A Orders each year.
