April 7, 2026 TO THE MISSISSIPPI HOUSE OF REPRESENTATIVES: GOVERNOR'S SIGNING MESSAGE FOR HOUSE BILL 1911 I am returning House Bill 1911: "AN ACT MAKING AN APPROPRIATION FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF THE MISSISSIPPI DEPARTMENT OF INSURANCE FOR THE FISCAL YEAR 2027" signed and accompanied by the following message. House Bill 1911 provides the legislative appropriation for FY 2027 to the Mississippi Department of Insurance. Additionally, HB 1911 provides to the Mississippi Department of Insurance the following escalation authority "contingent upon the passage of Senate Bill 2406, 2026 Regular Session":
SECTION 16. It is the intention of the Legislature, contingent upon passage of Senate Bill 2406, 2026 Regular Session, that the Department of Insurance shall
have the authority to escalate an amount not to exceed Fifteen Million Dollars ($15,000,000.00) that is collected, received, or otherwise made available to the Strengthen Mississippi Homes Program Fund. These funds shall be used for defraying the operational expenditures of the department for the Strengthen Mississippi Homes Program. Such escalations shall be received and expended consistent with the rules and regulations of the Department of Finance and Administration. Additionally, the Department of Insurance shall have the authority to escalate the positions necessary to administer the program. Such escalations shall be made in accordance with the rules and regulations of the Department of Finance and Administration and the State Personnel Board. (emphasis added) Senate Bill 2406 (2026 Regular Session) was double referred by the Lieutenant Governor to the Senate Highways and Transportation Committee and the Senate Accountability, Efficiency and Transparency Committee on January 19, 2026. Senate Bill 2406 subsequently died in committee on February 3, 2026. (Id.) Accordingly, because the condition precedent for the $15 million in escalation authority contained in Section 16 has not, and cannot be met as a matter of law, the escalation authority provided therein to the Mississippi Department of Insurance is null and void.
