Tobacco and Vaporisers Control (Appearance, Packaging and Labelling) (Amendment) Regulations 2026
Summary
The Tobacco (Control of Advertisements and Sale) (Appearance, Packaging and Labelling) (Amendment) Regulations 2026 (S 241/2026) expand the scope of the principal Regulations 2019 to include vaporisers in addition to tobacco products. The amendments substitute 'Tobacco (Control of Advertisements and Sale)' with 'Tobacco and Vaporisers Control' throughout the principal Regulations. Regulation 28(1) is amended to expand sub-paragraphs defining when tobacco or vaporiser products are deemed 'in the course of business' to include products offered for sale, transported, sent, delivered, or distributed within Singapore, or in a person's possession for the purpose of sale or distribution. Regulations 29 and 30 similarly replace sub-paragraph (b). The Regulations were made on 21 April 2026 by the Minister for Health under section 37 of the Tobacco and Vaporisers Control Act 1993 and come into operation on 1 May 2026.
“These Regulations are the Tobacco (Control of Advertisements and Sale) (Appearance, Packaging and Labelling) (Amendment) Regulations 2026 and come into operation on 1 May 2026.”

What changed
The Amendment Regulations modify the Tobacco (Control of Advertisements and Sale) (Appearance, Packaging and Labelling) Regulations 2019 (G.N. No. S 480/2019) in three principal ways: (1) Regulation 1's citation is updated to reflect the inclusion of vaporisers; (2) Regulation 28(1) expands the scope of what constitutes products 'in the course of business' by adding new sub-paragraphs (c) and (d) covering products offered for sale or distribution, and products in possession for commercial purposes; and (3) Regulations 29 and 30 each replace their sub-paragraph (b). The cumulative effect is to bring vaporisers within the same packaging and labelling regime as tobacco products under Singapore law. Affected parties—importers, manufacturers, distributors, and retailers of tobacco products and vaporisers in Singapore—must ensure their products, labelling practices, and distribution activities comply with the updated Regulations by 1 May 2026.
